By accessing or using Nubila's website, hardware devices, APIs, software, mobile applications, or related services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Services.

2. Description of Services

Nubila provides environmental data infrastructure, weather-related data feeds, forecasting models, hardware devices, APIs, and related technology services. The Services are provided for informational and infrastructure purposes only.

3. No Financial, Trading, or Investment Advice

The Services do not constitute financial, investment, trading, or legal advice. Nubila does not offer securities, investment products, or guaranteed returns. Participation in the network does not guarantee income, financial benefit, or appreciation. Users are solely responsible for decisions made based on the data.

4. Data Accuracy Disclaimer

Environmental and forecasting data are model-based and subject to variability, latency, and measurement limitations. Nubila does not guarantee:

Accuracy
Completeness
Real-time availability
Fitness for a particular purpose

5. Hardware Use Disclaimer

Nubila hardware devices are intended for environmental data collection only. They are not safety-critical systems and must not be relied upon for:

Emergency decision-making
Aviation
Navigation
Life-support systems
Public safety operations

Improper installation or environmental misuse voids any warranty.

6. Limited Warranty (Hardware)

Nubila warrants hardware devices against defects in materials and workmanship for 12 months from delivery. This warranty does not cover damage caused by:

Misuse
Improper installation
Environmental exposure beyond specifications
Unauthorized modifications

Remedy is limited to repair or replacement at Nubila's discretion.

7. Limitation of Liability

To the maximum extent permitted by law:

Nubila shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Loss of profits
Trading losses
Business interruption
Data loss

Total liability shall not exceed the amount paid by the user for the relevant Service.

8. Acceptable Use

Reverse engineer the Services
Use data for unlawful purposes
Use Services in violation of export control laws
Attempt unauthorized access

9. Export Compliance

Users may not access or use the Services in violation of U.S. export control or sanctions laws.

10. Termination

Nubila may suspend or terminate access at its discretion.
